Mark Lefkow Wins Motion to Dismiss for Correctional Healthcare Client
Partner Mark Lefkow won a motion to dismiss in federal court in a case pending against the firm’s correctional healthcare client. Plaintiff’s counsel attempted to add the healthcare company to the suit after expiration of the statute of limitations, arguing that the addition of the client would relate back to the date of the original filing of the complaint. The district court rejected this argument, holding that the addition would not relate back because the client lacked notice of the suit within the statute of limitations.
