Matthew B. Jager and Laura D. Eschleman Secure Dismissal in Favor of Alabama Surgeon and His Practice
Matthew B. Jager and Laura D. Eschleman recently secured a dismissal in Alabama circuit court in favor of a surgeon and his practice. The plaintiff in that case alleged that a vascular deficiency prior to his surgery caused a post-operative infection, as well as extensive injury and years of subsequent hospitalizations and treatment. However, as the case progressed it became clear that Plaintiff was unable to meet the burden of establishing his medical malpractice claim under Alabama law. Matthew pursued summary judgment on all claims as a result, which ultimately led to the dismissal of Plaintiff’s case.
