Mark Lefkow Obtains Summary Judgment in Federal Personal Injury Case

Nall & Miller partner Mark Lefkow obtained summary judgment on behalf of a motor home manufacturer in a personal injury suit filed in federal court. The plaintiff contended that she broke her foot when she tripped on a motorhome step. She presented evidence that the steps she fell from had been recalled. Plaintiff and her witnesses made a number of critical admissions during questioning in their depositions that ultimately led to dismissal of the case. The federal court dismissed the case on account of lack of sufficient knowledge by plaintiff and her witnesses as to what caused the fall, coupled with plaintiff’s failure to preserve the steps.
