Matthew B. Jager and Laura D. Eschleman Win Summary Judgment in Favor of a Medical Oncologist and Oncology Practice

Matthew B. Jager and Laura D. Eschleman recently obtained summary judgment in state court in favor of a medical oncologist and an oncology practice. The plaintiffs in that case alleged that a delay in prescribing a type of treatment led to a permanent injury. However, the testimony of the plaintiffs’ expert fell short of establishing the causation element of the plaintiffs’ medical malpractice claim. Matthew was able to successfully argue at a virtual hearing that the plaintiffs’ expert’s testimony on causation failed to meet the statutory requirements for expert testimony under Georgia law, and, as a result, the plaintiffs could not establish their medical malpractice claim. The Court agreed and entered summary judgment on the plaintiffs’ claims in favor of the medical oncologist and oncology practice.
