The case arose from a collision between a freight train and a tractor trailer that failed to completely clear a railroad crossing. The Plaintiff claimed a low back injury as well as PTSD. Liability was admitted but the defense argued the plaintiff sustained no damages in the accident. Following expert testimony on damages, including significant amounts calculated for lost benefits from a union job with the railroad, the plaintiff asked the jury to award more than $3,300,000. After deliberating for an hour and a half, the jury came back with a unanimous verdict for the defense.
