Lefkow and Davidson Obtain Defense Verdict

 

Mark Lefkow and Meghan Davidson obtained a defense verdict in a three-day federal trial against a nurse and her employer, a correctional healthcare provider. Plaintiff made claims for First Amendment retaliation, professional negligence, and battery. The case involved administration of a pure protein derivative shot to test for tuberculosis, to which Plaintiff claimed he did not consent. Plaintiff had also claimed that nurses and corrections officers used excessive force on him. Alexia Roney filed a motion to dismiss before discovery commenced that resulted in dismissal of the excessive force and conspiracy claims before trial.
